A website that does not sell anything but lets users register, post content, comment or upload, such as a forum, a community, a free tool or a content platform, still needs terms of use towards users in Germany. The terms define what users may post, what rights the operator receives in the content, when accounts can be blocked and how the operator meets the obligations of the Digital Services Act on notice and action and on the statement of reasons. What the fixed fee of 400 EUR covers
The terms of use with the clauses on registration and account, rules of conduct, user content and the licence the operator needs, moderation and blocking with the procedures the Digital Services Act requires, liability for user content, termination and applicable law, plus the information on the contact point under Art. 11 and Art. 12 DSA. The texts are delivered in English and German, ready to publish. We check the integration into the registration process and the placement of the terms, because terms that are not validly included are not part of the contract under § 305 Abs. 2 BGB. One round of revisions after your comments is included, and as attorneys we are liable for the result.
What you should know
Even a free service is a contract under German law once the user registers, and the clauses are controlled under §§ 305 ff. BGB. The Digital Services Act applies to every hosting service that addresses users in the EU, with obligations that are scaled to the size of the service, and the terms of use are where most of them have to be reflected.

Prices are net attorney fees. For business clients outside Germany no German VAT is added.
