Subscriptions, memberships, software as a service, online courses, streaming, repair and other services sold to consumers in Germany are governed by consumer contract law that has become considerably stricter since 2022. Contracts concluded online must have a cancellation button, automatic renewals are limited to indefinite extensions with a one-month notice period (§ 309 Nr. 9 BGB), digital content and digital services carry a statutory warranty under §§ 327 ff. BGB, and the right of withdrawal applies to services as well, with special rules on when the service may begin. We draft the terms for a fixed fee of 1,000 EUR.
What the fixed fee of 1,000 EUR covers
The terms and conditions for the service, the withdrawal instructions and model form adapted to services and digital content, the clauses on term, renewal and termination that comply with German law, and the information on the cancellation button under § 312k BGB. The texts are delivered in English and German, ready to publish. We check the integration into your sign-up process, the subscription management, the cancellation button and the confirmation emails, because terms that are not validly included are not part of the contract under § 305 Abs. 2 BGB. One round of revisions after your comments is included, and as attorneys we are liable for the result.
What you should know
A consumer who was not correctly informed about the right of withdrawal can cancel a service contract for up to a year and may not have to pay for what was already provided. A renewal clause that does not meet § 309 Nr. 9 BGB is void entirely, so that the customer can terminate at any time. These two points cost foreign providers more money in Germany than any other, and both are solved by correct texts and a correct process.
