A website that addresses customers in Germany or elsewhere in the EU must meet the information duties of the GDPR and, for Germany, the Telecommunications Digital Services Data Protection Act (TDDDG) on cookies and tracking, and it must carry a legal notice (Impressum) under § 5 DDG. Competitors and consumer associations enforce these rules through warning letters, and supervisory authorities enforce them through orders and fines. For companies outside the EU that run a German or EU-facing website we provide the complete legal set-up for a fixed fee of 300 EUR.
What the package covers
We draft a privacy policy that is written for your actual website, not a generator text, covering the tools you use, such as analytics, advertising pixels, the shop system, payment providers, newsletter services and embedded content, and the transfers of data to your home country outside the EU. We draft or review the legal notice. We check the cookie consent banner against the requirements of § 25 TDDDG and the case law of the German Federal Court of Justice, and we review the contact form, the newsletter sign-up and the customer account for the consents and information they need. You receive the texts in English and German, ready to publish, with a short note on where and how to embed them.
What it does not cover
Terms and conditions for your shop or service are a separate product, see our fixed-fee offers for terms and conditions. If you instruct us for terms and conditions at the same time, the website package is reduced by half to 150 EUR. The appointment as EU representative is also separate, but the privacy policy we draft already contains the paragraph naming us as your representative if you appoint us.
Why German practice matters for a non-EU company
Germany has the most active enforcement of website data protection in the EU. Warning letters for missing privacy information, for Google Fonts loaded from Google servers or for a consent banner without a real reject option are sent in large numbers, and German courts award damages for unlawful transfers of IP addresses to the United States. A website set up for German practice is on the safe side in the other Member States as well. This is why we draft for the strictest market.
Prices are net attorney fees. For business clients outside Germany no German VAT is added.
