An app distributed through the Apple App Store or Google Play to users in Germany needs its own terms of use or terms and conditions, in addition to the store rules, and the fee depends on what the app does. Terms of use for an app without in-app contracts, such as a tool or a community, cost 400 EUR. Terms for a shop app selling to consumers cost 500 EUR, for a shop app for business customers 1,500 EUR, for a service app for consumers 1,000 EUR, for a service app for business customers 1,800 EUR, for an intermediary or platform app 1,600 EUR and for a coaching or training app 700 EUR. The privacy policy for the app, which the stores require before publication, costs 300 EUR.
What the fixed fee of 400 EUR to 1,800 EUR, depending on the type of app covers
The terms of use or terms and conditions adapted to the app and to the store through which it is distributed, with the clauses on account and access, in-app purchases and subscriptions in the way the stores process them, the right of withdrawal and its waiver for digital content, the licence to use the app, updates and the obligation to provide them under §§ 327f BGB, user content where the app has it, termination, liability and applicable law, plus the withdrawal instructions where the app sells to consumers. The texts are delivered in English and German, ready to publish. We check the integration into the onboarding screens, the store listing and the in-app purchase flow, because terms that are not validly included are not part of the contract under § 305 Abs. 2 BGB. One round of revisions after your comments is included, and as attorneys we are liable for the result.
What you should know
Since 2022 providers of digital products owe updates to consumers for as long as the consumer can reasonably expect them, and the terms must say how updates are provided. In-app subscriptions are processed by Apple and Google, but the contract with the user is yours, so the rules on term, renewal and cancellation of German law apply to you and must be reflected in the terms even though the store handles the payment.
Not included

Prices are net attorney fees. For business clients outside Germany no German VAT is added.
