Terms and conditions for an online shop selling to consumers in Germany, 500 EUR

An online shop that sells goods to consumers in Germany, from its own website, through Shopify, WooCommerce or any other system, must give the customer a defined set of information before the order, must provide withdrawal instructions and a model withdrawal form, must design the order button and the checkout in the way § 312j BGB prescribes, and must not use any of the clauses that §§ 308 and 309 BGB prohibit towards consumers. Shops based abroad that ship to Germany are subject to these rules in the same way as German shops, and they are the preferred target of warning letters because their terms are usually translations of home-country terms. We draft the complete set of texts for a fixed fee of 500 EUR.

What the fixed fee of 500 EUR covers

The terms and conditions for the shop, the withdrawal instructions and the model withdrawal form under Art. 246a EGBGB, the information on payment, shipping and delivery times, and the customer information that German law requires on the website. The texts are delivered in English and German, ready to publish. We check the integration into your shop, including the checkout, the order button, the confirmation email and the placement of the texts, because terms that are not validly included are not part of the contract under § 305 Abs. 2 BGB. One round of revisions after your comments is included, and as attorneys we are liable for the result.

What you should know

The right of withdrawal gives consumers in the EU fourteen days to return goods without reason, and the period does not start until the customer has been correctly informed. A shop that gets the instructions wrong faces a withdrawal period of twelve months and fourteen days. Shipping to Germany from outside the EU raises the question of customs duties and import VAT, which the customer must be told about before ordering, and since 2021 the EU One-Stop-Shop and Import-One-Stop-Shop rules apply to VAT. Not included

Terms for sales to business customers, which need a different set, see trade B2B. Marketplace sales through Amazon or eBay are covered by the marketplace package. The privacy policy and legal notice for your website are covered by the website privacy compliance package, reduced to 150 EUR when ordered together.

Prices are net attorney fees. For business clients outside Germany no German VAT is added.
