A seller on Amazon.de, eBay.de, Etsy, Kaufland or another marketplace addressing German consumers must display its own terms, withdrawal instructions, legal notice and privacy information in the seller profile, in addition to the rules of the marketplace. Marketplace sellers from the United States, the United Kingdom and Asia are the most frequent recipients of German warning letters, because the seller profile is public, easy to check and often empty or filled with a machine translation. We provide the complete set of texts for the marketplace for a fixed fee of 300 EUR.
What the fixed fee of 300 EUR covers
The terms and conditions adapted to the marketplace in question, the withdrawal instructions and model form, the legal notice with the information required under § 5 DDG for a foreign seller, and the short privacy information for the seller profile. The texts are delivered in English and German, ready to publish. We check the integration into the seller profile and the product pages, including the fields the marketplace provides for the texts, because terms that are not validly included are not part of the contract under § 305 Abs. 2 BGB. One round of revisions after your comments is included, and as attorneys we are liable for the result.
What you should know
The marketplace’s own terms govern the relationship between the marketplace and the buyer and between the marketplace and you. They do not replace your own terms towards the buyer, and they do not protect you against a warning letter. Since the Digital Services Act and the German implementation of the EU rules on marketplaces, the marketplace also verifies the trader information you provide, so the legal notice must match your registration data exactly.

Prices are net attorney fees. For business clients outside Germany no German VAT is added.
