Germany, Austria and Switzerland form one German-speaking market of around 100 million consumers, and a brand that is launched in one of these countries is usually sold in the other two within a short time. Because Switzerland is outside the EU, an EU trademark does not cover the whole region. Our package files three national trademarks, with the DPMA, the Austrian Patent Office and the Swiss IPI, for one attorney fee of 850 EUR instead of 1,250 EUR for three separate applications.
What the package covers
One assessment of registrability under the practice of all three offices, one search covering the German, Austrian, Swiss and EU registers, one list of goods and services adapted to the three offices, and three electronic applications filed in parallel. We handle the correspondence with all three offices until registration and act as representative or address for service in each country through our offices in Potsdam, Hallein and Felsberg.
Official fees
The official fees are paid to each office separately. They amount to 290 EUR for the DPMA for up to three classes, from 294 EUR for the Austrian Patent Office for up to three classes and 350 CHF for the IPI for up to three classes, each for an electronic application.
When the package is the better choice
Three national marks are the right choice when an EU trademark is blocked by an earlier mark in another Member State, when the mark is descriptive in a language of another Member State and would be refused by the EUIPO, or when Germany, Austria and Switzerland are the only European markets you serve. If you also sell in other EU countries, compare the package for the EU and Switzerland, which costs the same attorney fee and covers 28 countries.
Prices are net attorney fees. For business clients outside Germany no German VAT is added. Official fees of the trademark office are paid separately and are listed above.
