An EU trademark and a Swiss trademark together cover the entire European market with the exception of the United Kingdom, Norway and a few smaller countries. For a company from the United States, Canada, Australia or Asia that enters Europe, this is the combination we recommend most often. Our package files both applications for one attorney fee of 850 EUR instead of 950 EUR for two separate mandates.
What the package covers
The assessment of registrability under EUIPO and Swiss practice, a search of the EU, the national registers of the Member States and the Swiss register, one list of goods and services drafted so that it works before both offices, the two electronic filings and all correspondence with the EUIPO and the IPI until registration. We act as your representative before the EUIPO and as your address for service in Switzerland through our Swiss branch office, during the application and afterwards.
Official fees
The EUIPO charges 850 EUR for one class, 50 EUR for the second and 150 EUR for each further class. The IPI charges 350 CHF for an electronic application covering up to three classes. Both fees are paid to the offices in addition to our attorney fee.
Why not an international registration instead
An international registration under the Madrid System designating the EU and Switzerland is possible if you already hold a basic mark at home. It is often cheaper in official fees but depends on the basic mark for five years and leaves you without a representative in Europe until a refusal is issued. For a European market entry with a new brand, two direct applications give you a cleaner position. We are glad to compare both routes for your case.
Prices are net attorney fees. For business clients outside Germany no German VAT is added. Official fees of the trademark office are paid separately and are listed above.
