Coaches, trainers and course providers who sell to clients in Germany, online or in person, operate in an area where German courts have become strict. High-priced coaching programmes have been declared void by several courts under the Distance Learning Protection Act (FernUSG) where the provider had no state approval, the right of withdrawal applies to online courses, and the clauses on cancellation and refunds are checked against consumer law. We draft the terms for coaching and training for a fixed fee of 700 EUR.
What the fixed fee of 700 EUR covers
The terms and conditions for coaching, training or courses with the clauses on booking and payment, the start of the service and the waiver of the withdrawal right where the client wants to begin immediately, cancellation and rescheduling, the description of the service that keeps the contract outside the Distance Learning Protection Act where this is possible, intellectual property in the course materials, confidentiality, liability and applicable law, plus the withdrawal instructions and model form. The texts are delivered in English and German, ready to publish. We check the integration into your booking page, payment process and the confirmation emails, because terms that are not validly included are not part of the contract under § 305 Abs. 2 BGB. One round of revisions after your comments is included, and as attorneys we are liable for the result.
What you should know
The Distance Learning Protection Act applies to courses taught at a distance with monitoring of the learning success, and a contract that falls under it without the required approval is void, so that the client can reclaim the full fee. Whether a programme falls under the act depends on its design, and this is where we start. For business clients the rules are more relaxed, but German courts have applied the act to business clients as well.
Not included
The approval procedure under the Distance Learning Protection Act, which we handle separately if the programme requires it. The privacy policy and legal notice for your website are covered by the website privacy compliance package, reduced to 150 EUR when ordered together.
Prices are net attorney fees. For business clients outside Germany no German VAT is added.
