A company that runs Facebook, Instagram, LinkedIn or TikTok pages for the German market is subject to German rules on these pages as well. The page needs a legal notice that is reachable with two clicks (§ 5 DDG), the privacy policy must cover the page and the joint controllership with the platform that the Court of Justice of the EU established for Facebook pages, advertising must be labelled under § 5a UWG and the Medienstaatsvertrag, and competitions, influencer cooperations and the use of music and images follow rules that differ from those in the United States or the United Kingdom. Warning letters from competitors are frequent, and each comes with a fee claim of several hundred euros. We check your website and up to two social media accounts for a fixed fee of 300 EUR.
What the check covers
For the website we review the legal notice, the privacy policy, the cookie consent and the links to the social media pages. For each account we review the profile information, the legal notice and privacy policy links, the labelling of advertising and cooperations in recent posts, the use of third-party content and the handling of comments and messages, which are personal data as well. You receive a written report in English with the defects found, their risk and the wording or change needed to fix them. Each further account is checked for 50 EUR.
What it does not cover
The drafting of a privacy policy for the website is part of the website privacy compliance package, which can be combined with the social media check. Terms for competitions and influencer agreements are drafted separately at a fixed fee we quote in advance.
Prices are net attorney fees. For business clients outside Germany no German VAT is added.
