An EU design registered with the European Union Intellectual Property Office (EUIPO) protects the appearance of your product in all 27 member states with one application, including Germany, Austria, France, Italy and Spain. Switzerland and the United Kingdom are not covered. The fixed attorney fee is 400 EUR including representation before the EUIPO.
Official fees
The EUIPO charges 350 EUR for the first design and 125 EUR for each further design in a multiple application. If publication is deferred, an additional 40 EUR for the first and 20 EUR for each further design apply.
Term of protection
Protection runs for five years from the filing date and can be renewed in five year steps up to a maximum of 25 years.
Deferred publication
Publication can be deferred for up to 30 months from the filing or priority date. The request has to be made with the application. This is useful if there is time between filing and launch and competitors should not see the design in the register beforehand.
And Switzerland?
An EU design gives no protection in Switzerland. If you also sell there, you need a Swiss design in addition. More background on novelty, images and timing is on our design registration overview.
Prices are net attorney fees. For business clients outside Germany no German VAT is added. Official fees are paid separately and are listed above.
