Swiss trademark registration with the IPI, 450 EUR attorney fee

Switzerland is not a member of the European Union, and an EU trademark gives no protection there. A company that sells to Swiss customers, ships to Switzerland or has Swiss distributors needs a separate Swiss trademark registered with the Swiss Federal Institute of Intellectual Property (IPI) in Bern. Our branch office in Felsberg in the canton of Graubünden handles Swiss filings. The fixed attorney fee is 450 EUR.

What the fixed fee covers

We assess registrability under Swiss practice, which differs from EU practice in points such as the treatment of geographical names and of marks in English, search the Swiss and international registers for earlier marks, draft the list of goods and services and file electronically with the IPI. Correspondence with the office until registration is included. The IPI examines absolute grounds only and leaves conflicts with earlier marks to the opposition procedure, which runs for three months after publication.

Official fees of the IPI

The IPI charges 350 CHF for an electronic application covering up to three classes and 450 CHF where electronic filing is not possible. Each additional class is charged separately. The fee is paid to the office in Swiss francs in addition to our attorney fee.

Address for service in Switzerland

An applicant without a domicile or seat in Switzerland must designate an address for service in Switzerland, otherwise the IPI will not process the application (Art. 42 MSchG). Our Swiss branch office serves as your address for service during the application and after registration, so that office letters and renewal reminders reach you through us. Clients who file themselves can instruct us for the address for service alone.

Prices are net attorney fees. For business clients outside Germany no German VAT is added. Official fees of the trademark office are paid separately and are listed above.
