The Madrid System administered by the World Intellectual Property Organization (WIPO) in Geneva allows you to extend an existing trademark to more than 130 countries with one international application. The application is based on a trademark you already hold or have applied for in your home country, the so-called basic mark, and is filed through the office of that country. We handle international registrations for clients whose basic mark is a German, Austrian, Swiss or EU trademark, and we advise applicants from other countries that want to designate the EU, Germany, Austria or Switzerland in their international registration. Our attorney fee is 400 EUR plus 100 EUR for each designated country or office.
What the fee covers
We check that the basic mark and the international application correspond, which the home office examines strictly, select the designated countries with you, draft the list of goods and services so that it fits the basic mark and the practice of the designated offices, and file the application through the office of origin. We monitor the WIPO registration and the examination by each designated office. If a designated office issues a provisional refusal, we tell you what it means and quote separately for the response, because a response in, for example, the United States or Japan requires a local attorney.
Official fees
WIPO charges a basic fee of 653 CHF for a mark in black and white and a complementary or individual fee for each designated country. The amounts differ widely between countries and can be calculated with the WIPO fee calculator before filing. We send you the calculation with our quote.
Dependency on the basic mark
For five years the international registration depends on the basic mark. If the basic mark is cancelled or refused in that period, the international registration falls with it. This is the reason why we recommend that the basic mark be registered, or at least searched carefully, before the international application is filed.
Designating the EU, Germany, Austria or Switzerland
If your international registration designates the EU and the EUIPO issues a provisional refusal, you will need a representative in the European Economic Area to respond. The same applies to Germany, Austria and Switzerland. Prices are net attorney fees. For business clients outside Germany no German VAT is added. Official fees of the trademark office are paid separately and are listed above.
